History of the Federal Firearms License

In 1968, an act was passed requiring a license for individuals and businesses dealing with the sale and manufacture of firearms and ammunition.  This act, the Gun Control Act of 1968, was signed into law by President Lyndon B. Johnson on October 22, 1968, and it served as the beginning of the Federal Firearms License (FFL).

Many believe that the catalyst for this particular legislation was the assassination of President John F. Kennedy in 1963.  Because President Kennedy’s assassin used a mail-order rifle purchased from a magazine ad, people began to discuss whether regulation was needed in regards to the manufacture and sale of firearms.

The eventual passage of the Gun Control Act of 1968 did just that.  With the act’s passage, a Federal Firearms License from the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) became a federal requirement for the interstate and intrastate sale of firearms.  Proponents of this act hoped that by keeping the sale of firearms amongst licensed dealers that guns would be less likely to end up in the wrong hands.

In addition to ending mail-order shotgun and rifle sales, the Gun Control Act of 1968 also put limits on who could purchase firearms.  Convicted felons, drug users, and the mentally incompetent were now banned from purchasing guns. This was taken a step further in 1993 with the passage of the Brady Handgun Violence Prevention Act.  The Brady Handgun Violence Prevention Act brought about the requirement for background checks and spelled out in even more detail who was banned from purchasing firearms.
